This DMCA & Copyright Policy explains how Inkelys (https://inkelys.com) approaches copyright and other intellectual-property concerns and how a rights holder can report content that they believe infringes their rights.
1. Respect for Copyright
Inkelys respects the rights of authors, photographers, tattoo artists, designers, illustrators, creators, publishers, brands, and other rights holders. Copyright protection may apply to written articles, photographs, illustrations, graphics, video, artwork, and other original creative works. Under Morocco’s copyright framework, Law No. 2-00 concerns authors’ rights and related rights, as amended over time.
2. Content Published by Inkelys
Where a work is created by Inkelys, Inkelys may own or control the applicable rights unless another arrangement applies. Where content is licensed, submitted, embedded, quoted, linked, or otherwise used from a third party, the underlying rights may remain with the relevant rights holder. Nothing on this page should be read as a claim that Inkelys owns every image, tattoo design, photograph, logo, or reference appearing on the website.
3. Tattoo Images Require Careful Review
Tattoo-related images can involve several separate interests, including the photographer’s copyright, the tattoo artist’s creative rights, the person depicted in the image, trademarks or artwork incorporated into a tattoo, and contractual or licensing restrictions. A report should identify the specific work and right allegedly affected so that Inkelys can review the matter accurately.
4. Prohibited Copying and Republishing
Unless authorized, visitors should not copy, scrape, reproduce, republish, sell, mirror, redistribute, or systematically extract Inkelys’s original articles or other protected material. Quoting limited portions for legitimate purposes may be subject to applicable law, but the existence of a public webpage does not automatically grant permission to reproduce its contents.
5. How to Submit a Copyright Complaint
If you believe material on Inkelys infringes your copyright or another right you are authorized to enforce, send a written notice to admin@inkelys.com. A useful notice should include:
- Your full name and contact information.
- A clear description of the copyrighted work or other protected right.
- The exact URL of the material you believe is infringing.
- A description explaining why you believe the use is unauthorized.
- Information reasonably sufficient for Inkelys to identify the material concerned.
- A statement that you have a good-faith basis for the complaint.
- A statement that the information in the notice is accurate and that you are the rights holder or authorized to act for the rights holder.
- Your physical or electronic signature.
6. Review of Notices
After receiving a sufficiently detailed complaint, Inkelys may review the material, request clarification or supporting information, contact relevant parties, restrict access to disputed material, remove material where appropriate, or take other reasonable action consistent with applicable law and the circumstances. Sending a complaint does not automatically establish infringement.
7. Counter-Notifications and Disputes
Where material has been restricted or removed following a copyright complaint, the affected party may contact Inkelys with an explanation of why the use is authorized or why the complaint is disputed. Inkelys may request evidence of authorization, licensing, ownership, or other relevant information. Any formal counter-notification process will be handled according to the law applicable to the specific dispute.
8. False or Abusive Notices
Copyright complaints should be accurate and made in good faith. Knowingly submitting false, misleading, fraudulent, or abusive claims may create legal consequences. Do not use the reporting process to suppress lawful criticism, commentary, fair dealing, fair use where applicable, or material you do not have authority to control.
9. Repeat Infringement
Where appropriate and supported by the circumstances, Inkelys may restrict access to users or sources that repeatedly submit unauthorized material or repeatedly infringe intellectual-property rights.
10. Trademarks and Other Rights
Copyright is not the only intellectual-property issue that may arise. Logos, brand names, tattooed artwork, photographs of people, and other material may involve trademark, image, privacy, design, contractual, or other rights. Reports should identify the specific right at issue whenever possible.
11. No Automatic Safe-Harbor Claim
This policy does not represent that Inkelys is registered under any particular copyright safe-harbor program, nor does publication of this policy by itself create a legal safe harbor. The handling of any complaint will depend on the facts and applicable law.
12. Contact
Copyright and intellectual-property notices should be sent to admin@inkelys.com. Please provide the exact URLs and sufficient information for the matter to be reviewed.
Important: This policy is an operational website policy, not legal advice. Rights holders with complex disputes should obtain advice from a qualified intellectual-property professional.
